publish an app with the word Samsung

Hey guys!

We need your help:

We have an app that include the name Samsung,

and we got this message from apple:

Your app includes content or features from Samsung, or is marketed to control external hardware from Samsung, without the necessary authorization. The inclusion of third-party content within your app, whether retrieved from the internet by the app or embedded in the app, is subject to the terms of the Apple Developer Program License Agreement.

Your app and its contents should not infringe upon the rights of another party. In the event your app infringes another party’s rights, you are responsible for any liability to Apple because of a claim.

Yes, the name “Samsung” is a trademark, and unless you're licensed to use that trademark, you're violating it. I'd expect that Samsung would also be unhappy about this, particularly if you plan to make money from their trademark.

Direct3D has need of instancing, but we do not. We have plenty of glVertexAttrib calls.

Do you mean the name contains “Samsung”, or that you use it within your app?

Using it in the name is completely out.

Inside the program there are possibly some exceptions but they probably don't apply. Generally you should change it to not use their name. There are a few exceptions like if you must mention a specific item for compatibility reasons or to otherwise only refer to the name of it. Using a name like this, called nominative use, is a very narrow exception to trademark law that a lawyer would need to review. There are a few other exceptions but they are far less likely to apply.

Normally you must either get permission or not use it. Do one of those.
