What is the law in regards to what us programmers can do, eg whats the law on virii and trojens etc, like where do you draw the line between a trojen and a romote assistance/access tool? as I wouldnt mind attempting a semi-remote assistance tool, but I dont want to get into trouble or anything... You can write anything you want, the worse virus in the world for instance, and it should be legal.. It''s not illegal until you set it loose.

Sort of like bongs... they aren''t illegal to buy them, because just owning a bong is totally legal.. It''s not until you fill it with weed or crack that it becomes illegal to walk around the street with.

But what if I sent it to people, its not a trojen or virus so it cant spread itself or anything, or put it up on my website?

Distribution. You would also be an accessory to the crime if anyone used your virus/trojan.

Your not hearing me! its not a virus or a trojen!! I wouldnt know where to start making one of those!! its a freakin'' remote assistance type prog, but it may be boarderline trojen... im not sure how the law looks at such things.

Just make sure it''s very clear to the user what their installing and have some kind of thing saying you take no resposibility for damage caused by this program or damage caused through poeple misuing this program and you should be fine

Well, if you are so worried about it.. make whoever you are sending it to sign a waver form... make them sign (have their parents sign if they are under 18) that you are not responsible for any mis-use of the program. That''s about all i can really think to do about it.

If you''re just testing your own type of PC-Anywhere software, then i wouldn''t worry about it.

And if you are worried about your friends taking that software, and doing something malicious with it at your expense.. then maybe they aren''t your friends.

Well, its not like it would be very easy to use, like the other person would require the server software, and then they would have to send their IP etc... it would basicly be a "learn howto use Winsock" prog, that I will maybe expand on, eg, you would send a "header" saying that the following text was for the shellExecute() func, then u send "Notpad.exe", and it opens it, at first nothing extreme or amazing... but maybe it would be good and stuff...
And dont trojens require like a database of connected IP''s or something? so I cant do anything like that...

There is nothing wrong with writing remote administration tools. Why do you care so much about the law anyway?

Trojans work by infecting your computer somehow then quietly hiding themselves somehow and make themselves automaticaly start up with windows. Then they sit listening to a certain port. Script Kiddies use a thing called a port scanner to scan through ip address trying to connect to different ports. For example say 1337-7r0g3n was listening on port 2149 on your computer then the script kiddies port scanner gets onto your ip address it will try to connect to port 2149. If it's successful it knows there's something. It sends some kind of thing telling whatever it is in 2149 to veryify it's identity. Once it's worked out it's 1337-7r0g3n listening on port 2149 the script kiddie starts wreaking havoc on your comp.

Well thats one way. There are others

I would guess he doesn''t want to get the life sentence for possibly causing physical harm because of his program.

Either that, or he doesn''t want a number of federal agents bursting through his house, grabbing him and his equipment, and hauling him off into a van where we''ll never hear from him again.

On a side note, the book "Hack Attacks Revealed" has a number of related remote access/administration/"hacking" && whatnot source code listings, articles, etc... Pretty interesting read

remote administraion tools are totally legit (see telnet, ssh, X, etc). the key is to ensure that you CLEARLY specify it is a remot administration tool. its not a trojan if it does what is advertised. format deletes the contents of the drive your specify. its not a trojan since you need to tell it to format the drive, and it warns you of the results of the operation such as lost files that are not recoverable. having a disclaimer that you are not responsible if the software damages their pc is not too strong if it does things its not supposed. ie unclear documentation on its use, no fail safes to ensure the user dont make a mistake that could cause undesired results (ie the "Are you sure" question along with the consquences of pressing Yes).

a trojan is only a trojan if you the app does things that are undesired and the user is not CLEARLY made aware of. mentioning it the EULA is pretty weak considering there is no court case that even upholds a EULA as a binding agreement. furthermore saying something in a EULA does not mean its illegal. for instance if you say something like "by agreeing to this EULA you can longer use this computer without sending information to me about its use" is not legal at all. even worse is that some ppl (like me for instance) cant read many eulas because they choose to ignore my windows color scheme of black backgrounds in text boxes with orange text. instead they force black text and leave the text box background black. kinda tough to read (even hilighting dont work). also being that many EULAs are pretty bolier plate and confusing its easy to get away with not being bound by it since you can play the "i see so many and they dont make sense so i just click agree". some ppl even have went through the trouble of wiping the EULA text from the install or the entire agree process completely (pretty legal since they did not agree to anything when downloading the file, though they could not distribute the stripped file since its still copyright protected).

also if you dont make enough effort to make it secure from attacks, you could be liable for negligence (ie like making a car which could flip during normal use causing severe injury and loss).

i am not a lawyer, but this is information i have gathered from the various court cases and other discussions from more knowledgable people (ie ppl who are studing business law in college and actual lawyes).
