Hey there. I am not sure, and I do not know if this is right. But I think there is a license for using the FMOD library commercially. Do not take my word 100%, but I believe I have seen a disuccsion on this topic before. Hope this helps! :D

Short answer, yes, if you pay $1000 (more for consoles). If you use MP3 you need to get a licence for that seperately from Thompson Multimedia. It''s all covered, clearly, in their licence page.
