Why would MS send you an XBox 360 development kit ? I checked out your site and it seems that is what you are banking on. I would like to say good luck, but it's not luck you need. You need to be a game developer at the least or a publisher. A couple of things determine whether you are a game developer and just saying you are is not one of them.
On the other hand, I would suggest to do what the MS email says, build your game on windows platform using directx. Hopefully, sometime in the future you will have a demo product you can sell to a publisher that will invest in your game to fund it to completion.

Its not illegal, we purchased the liscesnse, and it doesn't expire till next may.
If it is from another company then how can you use it? It is licensed to them, not you.
Anyway, good luck with your project (you will need it) because it will cost millions of dollars to fund your game. Do you have that much money available?

Will Talk about payment to programmers based on input to project

we need Directx Programmers at this point, and anyone who has designed games before
Good luck.
are you developing this from scratch or will you be using some middleware?
if build from base up, wouldn't this need more than just couple of DX programmers, but programmers for every subsystem. eg. GUI, event handler, script engine, load/save, camera, animation, mesh loader, input, network, timing etc... so i am guessing/hoping this is not the route this project will be going.
i ask the above question because not much background has been given about the existing team or development plan, it is not easy to gauge where the project is going.. i am interested but i need to know more about the direction of the project before i can commit. :(
as for me, i have work on game engine of 7 months; not built directly on DirectX. i haven't mastered all the techniques (acadamic side, i only study game programming for half a year at polytechnic level) but i have a good understanding of the inner working of a game engine to build up its basic function.
