For some reason the rest of my post wouldn't show up after I replied, so here it is:

http://img219.imageshack.us/img219/7899/fwbz9.gif is my current file structure, with the uploads going into upload folder. This folder had a chmod 1777 put on it, so it should be good with read/write/edit.

Now the error my error log spits out:

So it's getting mad because it doesn't see it in the directory, but I have tried putting it their manually, and then trying to upload it, and tried without it there, both times have failed with this error.

Also, I put the 1777 chmod on the tmp folder that I just made, it has never been there before though :/

Looks like you're trying to move the uploaded file into the wrong directory. File paths are not automatically prefixed with the web root.

In any case, it's academic as your account (Both here and at your hosting company) is about to be banned for promoting warez.
