Technically you cannot use any IP without getting the explicit written permission of the IP holder. In this case, yes, you would technically need to have permission from Lucas Arts.

Mis-using IP is a civil law not a criminal law, meaning that not getting permission will not result in police at your door, it will just open you up to lawsuits by lucas. lucas has a history of suing anyone and everyone for infringing their IP so i wouldn't mess with it.

The reality is that lucas will never ever give you permission to use their IP. In the past they would license it to big developers to make games for them, but they've made an effort recently to take everything in-house to better control their brand.

Yes you need permission and no, it doesn't make any difference if your game is free or not.

Specifically, LucasArts Entertainment Company (LEC) has a tradition of stamping on fan-games, hard.

In other words, don't go there.
