Ok i need some advice

The other programer on my project hired to help code my vision has made a bit of a mistake.
so here is the flow of events
we have a NDA
Im trying to setup webpage he says i can do it no biggie so i ask my artists for the website images they have made
he then doesn't use any of them and "makes" a new logo with images right off google image
i went and looked and several bits of the overall logo are simply ripped from google
1 is from a tattoo shop that clearly states everything on the page is copyrighted

so since he is {stupid / naive / dumb / foolish} to do such a thing how should i handle this?
at this point im worried i have to go thru all the coding work he has done just to see if its
lifted from someone elses source code....

not happy with this so again Advice please

Have you asked him why he did that? Maybe he had a good reason to?

let me quote him here

"its copyrighted? how did you find out?"

either he wasent smart enough to look or dident care and dident think i would look

An NDA has nothing to do with it. Do you have a collaboration agreement? Is there a hierarchy, iow someone is the "boss"? Is there a universal understanding as to the purpose of the team, what product is being made, and what's to be done with the product?
And of course, as Steven asked, do you communicate with your teammates?

It still doesn't explain WHY he did it. That's the important part. At the moment, you have it in your mind that he did something wrong for the sake of doing something wrong. Got to the bottom of the problem and fix it from there. Maybe he doesn't understand the implications of using a copyrighted image? Maybe he was using it as a temporary placeholder? Maybe it was just the right colours for the rest of the site? Is the site even live?

the site was live i had him remove the image
and no we havent dont a contract yet as i just hired him friday and had him sign a NDA
yes he knows its a commercial venture
i spend all my time communicating with the team thats why i got a extra programmer
and ive spent probably 20 hours telling him whats expected of the final product and he still asks where in the story line XX RPG thing will happen in a game thats more sim than rpg
and he originally claimed he spent 3 hours making the image

so im just asking you all here is it worth trying to work with someone that might introduce things that can get the company sued?

You still haven't found out why. Have you asked him why he didn't use the artist's images?

Regardless, it sounds like a failure of procedure more then anything. Why did the content for the site go live without a stakeholder (i.e. you) checking it first?

If he continues not to do things that you have asked for without good reason and you find you are always at odds with him, then you two will have to part ways.

ohh sorry forgot that part he didn't like the original artwork

and i am rather upset it went live without him at least showing me the picture thats why i have taken away his website privileges and given them to a real web designer
that knows to run it by me first

and i now realize i have to be a lot more concrete with my policy etc.. hoped i wouldn't have to spend the time to make a employee handbook

Unbelievable. The guy does not understand what it means to work on a team. I predict he's going to give you more trouble.

Sod that. He should have come to you if he didn't like the artwork that was supplied. Cut him loose. You only found him last Friday and he is already not working as though he is part of a team. You can find better.

In my opinion as the guy who agrees with Steven, cut him loose. You can find someone who's not an idiot, someone who'll do what he's told or at least check with you before going off half-cocked.
