Apple wins over Samsung: thoughts?

Addendum: That little post took so long to write on my tablet. I don't think SwiftKey likes Gamedev's WYSIWYG editor so much.

@3Ddreamer, I gather all of that. The world won't accept such a systematic reboot, if only because that would depend on everyone being in agreement over the issue, and on mankind being able to handle that and getting it right. I kinda made that last comment about the world making no sense in jest, and alluding to this pivotal fact.

About litigation, again, it's a turf war. That's what all this amounts to.

tldr: its not gonna happen.


I am optimistic about the future, but I don't see such greatness for humanity in this present age. What if seeds for the future have already been planted?

Yes, it is a turf war, which is why many people are looking to truely open source solutions where possible.

Gamedev should create a petition for better patent laws.

I have always had little respect for Apple, for their intention to keep computing elite.
Everybody can do "quality" by charging customers.

But I've so far resisted in pronouncing about their technical prowess (I had better things to do so far than researching what they did and they did not).

Now, I'll take the patents they presented as a measure of their so called "progress". Because I take for granted they presented they best patents first.

Would be good to know what exactly these seven Apple patent claims ans five Samsung patent claims are. If they are UI-based patents, like "slide to unlock", or "homescreen design similarity", then this isn't as damaging as you might think.
One that they tried to use was rectangular shape with rounded corners, which would be damaging (and ridiculous), though I've yet to see if this one was held up.

I think slide to unlock would be fairly damaging, as it's a useful (and trivially obvious) way to unlock a touchscreen phone. It's also in vanilla Android.

Apple phones don't even _have_ a home/desktop screen yet, so that should be safe :)

I read that one was the "bounceback" when reaching the end of a list - personally I hate that. If it's at the end, then I don't want it to keep scrolling. Vanilla Android 4 shows you're at the end with a visual cue (though it's unclear to me you really need one - the cue is that it's stopped scrolling - unless your phone is so unstable you might have worried it's crashed or something).

I think it's pretty clear Samsung copied Apple.

I think $1b is a ridiculous sum.

And I think I'm still going to but the apple products I buy because I like them.
What do you mean by "copied"? Yes, I'm sure they looked at Apple products and said how can they improve - but the same is surely true of Apple. Yes, there are a few things in Samsung products that came first in Apple's. But the same is true of loads of features that are in Apple's phones, and were in earlier products.

But I don't see that any of the things here should be covered by patents, in my opinion. "Copying" is generally a good thing, and an essential part of technology and progress, due to the way that we advance by building on previous ideas. Jobs himself said good artists copy, great artists steal.

Same for Yudhisthira's comment - you are seriously suggesting it should be illegal for a company to look at other products? Or that using features already in other products is okay so long as you don't have a document on it?

For me, the conclusion is to never buy anything Apple again. Of course I've had that conclusion already after the PowerMac scam.

Apple: Buy PowerMac, they are cool. Your existing programs will still run, only better. PowerPC is such an awesome CPU.
Me: Ok, so I spent 5000 on this machine, and everything runs much slower. You said it has built-in Ethernet, too. Where is it?
Apple: Yeah, you need to buy a Level-3 cache chip. Oh, and you need buy a transciever for Ethernet.
Me: That transceiver is more expensive than a fully working network card on my PC. I thought you had Ethernet built-in?
Apple: Yeah, but we got Ethernet built-in. PC is shit. You still need a transciever.
Me: OK, so I bought the transciever and spent 700 on this cache chip, and it's still only about 50% the speed it was before on the 68040.
Apple: Yeah, you need to buy native applications too.
Me: Great... did that too, did I mention it crashes all the time, too? My 68040 Mac never crashed. It seems whenever virtual memory kicks in, the machine is unusable. This worked fine on my old Mac.
Apple: Uh... Think different.
[fast forward 3 years]
Apple: Yeah you know, PowerPC is shit, we are now going Intel. There are some very cool Intel Macs, go buy them.
Me: What's the difference to a PC?
Apple: PC is shit, we are cool.
