NEST EGG STUDIOS is currently in the stages of working on a MMORPG Sci-Fi Action Adult Game before pitched/business plan. NEST EGG STUDIOS is also an Enterprise and is venturing in an Animed Series and other products. Here is what our Graphcis Lead has to say about the Project "Heavenly Bodies". Subject: Re: NEST EGG PAST TOPICS Posted by: Guillotin... Posted: 02.12 - mon 17 sep 2001: Almost all the crop of current MMORPGs have the potential to be "adult" games simply by how the player plays. Chat interaction can become cybersex quite easily because it becomes cybersex in the mind of the player themselves. Therefore such games as UO or EQ can become quite sexually graphic in text. On the other hand if cybersex was explicitly supported in the game (ie. actions, animation etc.) the game would be classed as "adult", which to me spells a double-standard. Real life is x-rated. I think that people would want to play HB simply because of the freedom it provides. Players either do or don''t take advantage of all possible scenarios, rather than following some sort of puritanical guideline for acceptable moral behaviour. This is why I think HB has the possibility to be ground-breaking, simply because of the scope of freedom it provides. Are you asking them to sign to say that the work they produce is exclusively for your company, or are you saying that all IP''s to that work are signed over to you? If it''s exlusive to your company, but the person who did the work retains those IP rights (until paid for them, of course), then how long is the exclusivity to your company?

Those are two important questions that anyone should ask before signing any such contract.

Dear, Marc Lambert

I happen to have not left the site due to chatting with Concept Art workers on my team . I was about to close down when I saw ther was relpy..

Please Make note of this:
Please Post to the other messageboards I have supplised if you have General questions of inquiries. As I will not be revewing this site as often as I woudl like to ...Nor do I expect email from my post at this time.

To Answer your question.

When ever you sign for a work for Hire Contracted Position. All the work the Freelancer dose for that company Belongs solely to that company that is contracted for. This is common knowledge in the business world.

1. Ownership of copyright

Works Made for Hire In the case of a work made for hire, the employer or other person for whom the work was prepared is considered the author for purposes of this title, and, unless the parties have expressly agreed otherwise in a written instrument signed by them, owns all of the rights comprised in the copyright.

This is not a Licensing job for premaid works from a request to use, one to two pieces of work. from a Freelancer.

There are nesseary requirements, Disclousres (NDA''s) that go along with these contracts.
With each Contract there are Certain Rule, Regulations and Requirements. As well as other employment Opitions.

So there are Different kinds of empolyment options and Laws that go along with them.

I would love to get into this more If you would like . But please post NEST EGG STUDIOS messageboards.

If you have any more questions, don''t hesitate to Ask.

I asked here, because I want some of the people here to see what sort of questions they should be asking. I get a lot of people asking me to do this as much as I can, so I am doing this.

I want to address one of your points:

Not always no. This gives ALL the risk to the developer, he/she is doing this work for you with no guaranteed payment for that work. If he/she works on the game for 2 years and it ends up selling much less than you project, then he/she has lost 2 years of work.

I''ve done professional contract work and I''ve also worked under a company much like yours and NEVER did I sign away my IP rights without getting guaranteed pay. The company I worked for last, went nowhere with the various products I helped develop, I lost time and effort - but retained 100% of my work and I have put most of that work to use in my new position.
Signing over my IP rights to that company would have lost me thousands of man hours and gained me absolutely nothing. I wouldn''t even beable to have that work in my portfolio or on my cv.

I hope you can see what I''m trying to convey, this is by no means any sort of attack on your company or business structure. I''m just helping to inform some of the people here who have no experiance in these matters.
