I want to use this Napoleonic music, rights unclear

Working on a napolenic warfare RTS, I need military music of the time and I found this album which is exactly it

Problem is I'm not sure at all if I would be in the right to use this. Publication date is 1965 which is not old enough to be in the public domain, but it's distributed by the Kahle-Austin Foundation which is a big advocate for the Free Software Foundation (I know Free as in Freedom, not beer).

Would someone know if this is free to use?

You're planning to use the composition and make your own performance of the composition, correct? Do you know if the composition goes back to Napoleonic times?

@aganm , if you want to use the recording, you definitely need to obtain permission, or confirmation from the KAF that the recording is okay to use.

Thanks. Yes, if the recording was in the public the domain for example I would use it, otherwise make my own composition.
