First of all sorry if this thread is in the wrong forum, i really don't know the right place for this topic. I got this question after seeing this picture: http://www.gamedev.net/community/forums/topic.asp?topic_id=363276 Can you use stuff like this in your game? Can you use the name and appearance of an existing object (in this case a weapon) in your game for free or do you have to pay for them? Or does this all differ from object to object and wether your game is free etc etc... I hope this makes some sence since i have some problems putting my question in english. Thanks in advance, Scorpie

I understand what you're saying. The general answer is 'no'. If you have a mercedes ingame and you label it as such, you better have permission or you'll get sued. There are a few public lisence items (i think some guns used in games are under the GNU public lisence).

Remember of course that it's ok to have copyrighted material in projects produced for educational purposes (infact you can rip existing game content with no problems as far as i know).

The general answer is 'yes, unless it's a registered design' – but you can't put a trademark badge (like the Merc star) on without permission. I think. IANAL, don't quote me if you end up in court ;).

Thanks for the replys so far, looking at the replys i see my question was clear enough :)

Can somone provide more specific info on what is allowed and what isn't? As Bob Janova says that it's alright to use designs but not the trademark and so?

ps. i was just wondering, im not working on a commercial product atm so i wont drag you to court ;)
