It's illegal unless you have permission from the IP holder. Don't do it.

In the past, the IP holders for Star Trek have not been aggressive in defending their IP against fan-made games. There are several Star Trek fan-games out there which have been active for quite some time. Do with that what you will, and consider how much work you would be willing to put into something that could be unexpectedly obliterated at any time, at the whim of a legal department.

Just so you know, the amount of money involved does not change the legality of it. A small little fan game with no money involved still infringes on their copyright, and they can shut you down at a moment's notice if they choose to do so.

Not to mention they can still sue you for damages. That means they can go after your personal wealth to recover losses. And if they want, they can drum up some impressive loses. (Such as blaming poor sales of their own product on having to compete with your product. Suggesting poor quality of your product hurt their own, etc, etc.)

Or you can contact CBS(who i believe owns most of the IP right now) and see if you can get permission to make and publish a fan game, The worst thing that will happen is that they'll say no.

icarusredux,
You should read the FAQ for The Business And Law forum (where this thread has been moved to).

There was a game called EGA Trek that was based off the old Star Trek text based game ( http://en.wikipedia.org/wiki/Star_Trek_%28text_game%29 ). Basically they just released a shareware version but changed the names in it, but the mechanics were (IIRC: exactly) the same as the start trek game.

So it is posible to make a game that has the same feel as a start trek game, but the graphics and names are different.
